The Red Sox Defeat The Mighty Sex Rod

The Boston Red Sox might not have been able to beat the Tampa Bay Rays in a very entertaining ALCS, but that doesn't mean the organization isn't tasting sweet victory in other arenas of life. You see, back in July 2005 a man named Brad Francis Sherman came up with an idea that was bound to make him a millionaire. Step one of his master plan was to put the words "sex rod" on a bunch of different items of apparel. Step three was profit.

Unfortunately, Brad didn't think about step two, which was to trademark it and then have the Red Sox oppose that trademark and take him to court. They did, and Brad lost.
The Red Sox opposed the trademark based on its similarity to their logo, that it was immoral and scandalous, that it disparaged the team and falsely suggested that the team endorsed it.

In its opposition, the Red Sox connected the term 'rod' to the male anatomy and the court was not pleased that Sherman had registered the mark to use it on children's wear. But one of the main issues for the Trademark Trial and Appeal Board, which hears these cases, is that Sherman couldn't produce any goods that he had put the mark on.
Now at first you were probably pretty shocked to hear that Sherman planned to put sex rod on children's clothes, but may I remind you that Brad has three first names for a name? Those folks tend to be a little off.

No word on whether Alex Rodriguez planned to oppose the trademark as well, seeing as how it's Madonna's nickname for him.
