Roberto Alomar (seen to the right in April of 2008) received a shocking set of legal papers Tuesday, as his ex-girlfriend, Ilya Dall, filed a lawsuit in state and federal court alleging that Alomar had unprotected sex with her while knowingly infected with AIDS. As a result of these claims, she is suing the likely Hall of Famer for $15 million.The New York Daily News initially reported the lawsuit, which is absolutely packed with -- whether they are valid or not -- shocking allegations. Included are claims that Alomar was raped as a 17-year-old, suffered from erectile dysfunction and has been inflicted with HIV and AIDS for some time now.
The sexually-specific allegations (as gleaned from The Smoking Gun's copy of the lawsuit) revolve around Alomar engaging in unprotected sex with Dall from 2002 through December of 2005; Dall's suit also alleges that Alomar received a positive HIV result on February 6, 2006, stemming from a January 27, 2006 test.
Alomar's camp took a decidedly strong stance against the claims.
His lawyer, Charles Bach, would not say whether Alomar is HIV-positive. "We believe this is a totally frivolous lawsuit. These allegations are baseless," Bach said. "He's healthy and would like to keep his health status private. We'll do our talking in court."Sandy Alomar, the second baseman's father and a former major leaguer as well, said it was the "first time" he'd ever "heard of that" and that his son's ability to keep such an illness secret for that long would be surprising.
Alomar himself could not be reached for comment.
